This article seeks to answer this important question as to what is the basis for dignity in the Qur'anic approach and whether the human can claim his basic rights such as equality and freedom based on it. International human rights documents have underscored dignity as the basis of human rights, however it do not dwell on the basis and the meaning of dignity which require serious contemplations. The findings of the paper show that human dignity in the Qur'an is due to his "reason and nature" and God honored man by the virtue of these two blessings. In such a case, the necessity of linking human rights with dignity is to make a link between the rights and the reason and nature, while no one among the human rights advocates has bound himself to it. On the other hand, assuming that human dignity has legal effects, the fundamental difference is the relation between human and dignity in a non-religious approach with the relation between humanity and dignity in the religious approach which separates the paths of these two.}, keywords = {dignity,Inner Dignity,Inherent Dignity,acquired dignity,Human rights}, title_fa = {نگرش دینی به رابطه کرامت انسان و حقوق بشر}, abstract_fa = {«کرامت انسان» در اندیشه دینی و اسناد بین‌المللی، به‌غایت توجه شده و تلاش شده است آثار حقوقی متعددی به‌ویژه در حوزه حقوق بنیادین بشر بر آن مترتب شود. مقاله حاضر به‌دنبال پاسخ‌گویی به این پرسش مهم با روشی تحلیلی است که مبنای کرامت در رویکرد قرآنی چیست؟ آیا می‌توان بر اساس آن، انسان را نسبت به حقوق بنیادینی چون برابری و آزادی، ذی‌حق دانست؟ اسناد بین‌المللی حقوق بشر، به کرامت به‌عنوان مبنای حقوق بشر تأکید می‌کند، ولی به معنا و مبنای خود کرامت که نیازمند تأملات جدی است، نمی‌پردازد. یافته‌های مقاله نشان می‌دهد کرامت تکوینی انسان در قرآن به‌دلیل دارابودن «عقل و فطرت» بوده، خداوند به‌واسطه این دو موهبت، انسان را تکریم کرده است. در چنین حالتی، لازمه پیوند حقوق بشر با کرامت، پیوند این حقوق با عقل و فطرت است، درحالی‌که هیچ‌یک از طرفداران حقوق بشر به آن ملتزم نشده‌اند. ازسوی‌دیگر با فرض اینکه بر کرامت انسان آثار حقوقی مترتب شود، تفاوت اساسی در ملازمه میان انسان و کرامت در رویکرد غیردینی با ملازمه میان انسانیت و کرامت در رویکرد دینی است که مسیر این دو را از یکدیگر جدا می‌سازد.}, keywords_fa = {: کرامت,کرامت تکوینی,کرامت ذاتی,کرامت اکتسابی,حقوق بشر}, url = {https://www.sijl.ir/article_134924.html}, eprint = {https://www.sijl.ir/article_134924_3a93e50fdeac1e0475e8fafe7940d4d4.pdf} }
