Is it possible to impose or punish a matter of heart and thought? How is this consistent with the view that there is no compulsion in religion? The author of the article tries to prove that the punishment of apostate is not because of his belief but for his criminal act; therefore, if apostasy originates from a scientific doubt - but not carnal desires - one should strive to remove it, and unless his obstinacy is proved he should not be punished. Therefore, although belief is a matter of heart not capable of being imposed, criminal conduct or act is voluntary and optional. Therefore, there is no conflict between the view that “there is no compulsion in religion” and the punishment of the apostate. As the holy war with unbelievers is intended to provide the ground for calling and communicating the word of Allah to the people and in this path the tyrants are removed but religion is not imposed.}, keywords = {Apostate,freedom of thought,There is no Compulsion in Religion}, title_fa = {مجازات مرتد و پاسخ به شبهات؛ با نگاهی به دیدگاه آیت‌الله معرفت}, abstract_fa = {مجازات مرتد در فقه اسلامی، امری مسلّم است، ولی آیا مجازات مرتد فقط به‌سبب اتخاذ یک عقیده است یا به‌سبب فسادانگیزی، تضعیف جامعه دینی و مقابله با حکومت اسلامی؟ آیا امر قلبی و عقیده‌ای قابل تحمیل و مجازات است؟ این موضوع با عدم اکراه در دین چگونه سازگار است؟ نویسنده درصدد اثبات این نکته است که مجازات مرتد، نه برای داشتن یک عقیده، بلکه برای یک عمل مجرمانه است؛ بنابراین اگر منشأ ارتداد، شبهه علمی باشد ـ نه خواسته‌های نفسانی ـ باید در رفع آن کوشید و تا عناد و لجاجت وی ثابت نشده است، باید از مجازاتش خودداری کرد؛ بنابراین گرچه عقیده، امری قلبی است که قابلیت اکراه و اجبار ندارد، ولی رفتار و عمل مجرمانه امری اختیاری است؛ ازاین‌رو منافاتی میان «عدم اکراه در دین» و مجازات مرتد وجود ندارد. همان‌گونه که جهاد با کفار برای فراهم‌شدن زمینه دعوت و رساندن کلمه حق به مردم است و در این مسیر، طواغیت از سر راه برداشته می‌شوند، ولی دین تحمیل نمی‌شود.}, keywords_fa = {مرتد,آزادی عقیده,لا إکراه فی‌الدین}, url = {https://www.sijl.ir/article_134907.html}, eprint = {https://www.sijl.ir/article_134907_9049d9cdf2a98172ae08753912ce9dce.pdf} }
