Imprisonment in Islam means restricting the offender from free movement and movement, and in Islamic jurisprudence, various methods have been prescribed for this purpose. One of the methods that is recommended today and is considered as an alternative to imprisonment is house arrest. In this way, the offender is allowed, in addition to enduring his sentence, to have the opportunity for economic, educational and social activities outside the prison. The Holy Qur'an also speaks of imprisonment at home, but there is disagreement as to whether or not to abrogate it. Even if it has been abrogated, this abrogation refers to a specific crime, and therefore it is possible to use the narrations that indicate the legitimacy of such an action, especially according to Islamic jurisprudence, considering the situation of this institution in the beginning of Islam and its application in different cases. The legitimacy of such a punishment, as well as the disadvantages of its harm and corruption compared to imprisonment, can be proven. The only obstacle that can be seen in the way it is implemented is the way provided by today's laws, which in some cases may conflict with the privacy of individuals. The present article explores this issue with an analytical-descriptive method in order to examine house arrest from the perspective of Quran, hadiths and Islamic jurisprudence.}, keywords = {}, title_fa = {حبس خانگی ازمنظر قرآن کریم، روایات و فقه اسلامی}, abstract_fa = {منظور از حبس، سلب آزادی بزهکار از تصرف و آمدوشد آزادانه است که امروزه باوجود پذیرش آن در زرادخانه کیفری کشورها به‌سبب آثار و پیامدهای سوء آن بر استفاده از جایگزین‌های زندان تأکید می‌شود؛ ازجمله این جایگزین‌ها، حبس خانگی است که در آن به مجرم اجازه داده می‌شود علاوه بر تحمل دوران محکومیتش در محیط خانه فرصت فعالیت‌های اقتصادی، تربیتی و اجتماعی را بیابد. این جایگزین افزون بر کم‌هزینه‌تر‌بودن و پیامدهای سوء کمتر برای خانواده، فرصت اصلاح و بازپروری بیشتری برای بزهکار فراهم می‌آورد و از همه مهم‌تر حق بر آزادی بیشتر و بهتر پاس داشته می‌شود و نمونه‌ای از سیاست جنایی مشارکتی است. مطالعه منابع اسلامی نشان می‌دهد در اسلام هرچند به‌طور محدود حبس تجویز شده، اما حبس خانگی پذیرفته شده است. البته در کمّ و کیف دلالت گزاره‌های اثبات‌گر حبس خانگی بحث‌های جدی وجود دارد. مقاله حاضر با روش تحلیلی – توصیفی به کنکاش این موضوع می‌پردازد تا حبس خانگی را ازمنظر قرآن کریم، روایات و فقه اسلامی بررسی نماید. یافته‌های پژوهش حاکی از آن است که افزون بر امکان استفاده از گزاره‌های مثبت التعزیر بیدالحاکم، از گزاره‌های خاص موجود در قرآن کریم و روایات درمورد حبس خانگی در مشروعیت آن می‌توان بهره جست؛ هرچند برخی آن را اقدامی پیشگیرانه می‌دانند. به‌نظر می‌رسد این اقدام دارای ماهیتی دوگانه است. درهرحال باتوجه به محدودیت‌هایی که نسبت به حقوق مهمی همچون حق بر تربیت و حق بر حریم خصوصی ممکن است ایجاد کند، کاربست آن نیازمند وضع ضوابط ویژه‌ای است.}, keywords_fa = {حبس خانگی,نظارت الکترونیکی,حریم خصوصی,جایگزین زندان}, url = {https://www.sijl.ir/article_142650.html}, eprint = {https://www.sijl.ir/article_142650_4a1a708e0160b01d8eaf4393e183b10d.pdf} }
